FACTUAL SUMMARY OF TOWN OF BUENA VISTA LODGING OCCUPATION TAX BALLOT ISSUE 2A

The Buena Vista Board of Trustees has set a Special Mail Ballot Election for November 6, 2018, which asks eligible Town electors to vote on a Lodging Occupation Tax. 

The Lodging Occupation Tax is initially set at $3.00 per day per occupied lodging room if the lodging property is assessed at the commercial rate by the Chaffee County Assessor (typically hotels and motels).   The Lodging Occupation Tax is initially set at $5.00 per day per occupied lodging room (applied per booked unit) if the lodging property is assessed at a rate other than at the commercial rate by the Chaffee County Assessor (typically short-term residential rentals, recreational vehicle pads, or similar accommodations).  The lodging occupation tax applies to lodging rentals of thirty (30) consecutive days or less.  The tax may be decreased or increased without further voter approval so long as the tax does not exceed $6.00 per occupied lodging room.

  • The entirety of the revenues raised by the proposed Buena Vista lodging occupation tax will be used for capital infrastructure projects including public safety equipment and facilities, open space and recreational areas and facilities, signage and wayfinding, and Town beautification.
  • There is an existing 1.9% Chaffee County Lodging tax. 
  • No portion of Chaffee County lodging tax is distributed to Chaffee County municipalities. 
  • State statute 30-11-107.5 restricts County Lodging funds to be used only to advertise and market tourism and no revenue can be used for any capital expenditures, with the exception of tourist information centers.

Town of Buena Vista active voters will receive two ballot packets the week of October 15th:  A ballot packet from the Town of Buena Vista related to the Lodging Occupation Tax, and a second ballot packet from the Chaffee County Clerk and Recorder containing the State and County candidate and ballot questions.  The Town of Buena Vista ballot must be returned to the Town of Buena Vista, and not to the County, as designated on the ballot packet.

Arguments for the Ballot Issue

The lodging occupation tax will provide revenue needed by the Town to maintain Town infrastructure and services benefitting residents and attracting visitors to the Town. 

Arguments against the Ballot Issue

The lodging occupation tax will impose an additional cost on visitors wishing to lodge in the Town and discourage them from visiting and staying in the Town.

BALLOT TITLE AND TEXT:      Lodging Occupation Tax

Ballot issue no. 2A

SHALL THE TOWN OF BUENA VISTA TAXES BE INCREASED BY TWO HUNDRED ELEVEN THOUSAND NINETY SEVEN DOLLARS AND SEVENTY FIVE CENTS ($211,097.75) ANNUALLY IN THE FIRST FISCAL YEAR AND BY WHATEVER ADDITIONAL AMOUNTS ARE RAISED ANNUALLY IN EACH SUBSEQUENT YEAR BY THE LEVY OF AN OCCUPATION TAX ON THE PROVISION OF LODGING ON PROPERTY EXCLUSIVELY ASSESSED AS COMMERCIAL IN THE AMOUNT OF THREE DOLLARS ($3.00) PER DAY PER OCCUPIED LODGING ROOM AND ON ALL OTHER PROPERTY IN THE AMOUNT OF FIVE DOLLARS ($5.00) PER DAY PER OCCUPIED LODGING ROOM, BY EVERY PERSON OR BUSINESS THAT FURNISHES ANY HOTEL ROOM, MOTEL ROOM, LODGING ROOM, SHORT-TERM RENTAL ROOM, RECREATIONAL VEHICLE PAD, OR OTHER SIMILAR ACCOMMODATION FOR CONSIDERATION FOR THIRTY (30) CONSECUTIVE DAYS OR LESS WITHIN THE TOWN OF BUENA VISTA, WITH BOTH RATES LEVIED WITH THE RATE OF SUCH TAX BEING ALLOWED TO BE DECREASED OR INCREASED WITHOUT FURTHER VOTER APPROVAL SO LONG AS THE RATE OF THE TAX DOES NOT EXCEED SIX DOLLARS ($6.00) ON ANY TYPE OF PROPERTY PER DAY PER ROOM OR ACCOMMODATION, COMMENCING ON JANUARY 1, 2019, AND SHALL THE FULL REVENUES GENERATED BY SUCH TAX DURING 2019 AND EACH SUBSEQUENT YEAR BE COLLECTED, RETAINED AND SPENT BY THE TOWN, AS A VOTER-APPROVED REVENUE CHANGE, BE USED TO FUND CAPITAL EXPENDITURES FOR PUBLIC SAFETY EQUIPMENT AND FACILITIES, OPEN SPACE AND RECREATIONAL AREAS AND FACILITIES, SIGNAGE AND WAYFINDING, AND TOWN BEAUTIFICATION, WITHOUT REGARD TO ANY EXPENDITURE, REVENUE-RAISING, OR OTHER LIMITATION CONTAINED IN ARTICLE X, SECTION 20, OF THE COLORADO CONSTITUTION
